Marketplace agreement

The terms governing transactions between buyers and professionals on WorkLink.

This document sets out the intended structure of WorkLink's terms. It has not yet been reviewed by an Australian legal practitioner and must not be relied on as the final agreement. Questions in the meantime go to support.

The parties

A job arranged on WorkLink is a contract between the customer and the professional. WorkLink Australia Pty Ltd is not a party to it. We provide discovery, the record of what was agreed, messaging, and a dispute process for platform issues.

The professional is an independent business. They are not an employee, contractor or agent of WorkLink, and WorkLink does not direct or supervise how the work is performed.

Formation of a contract

A quote is an offer. Accepting a quote forms the contract, and the accepted version of the quote defines the scope, the timeline, the terms and the price.

Once accepted the quote is locked and cannot be revised. Changes after that point are a new quote for additional work.

Settlement for the work

Settlement for the professional's work is arranged directly between the customer and the professional. WorkLink does not hold funds or process that payment.

Partner subscriptions and advertising are billed separately according to the plan the professional has chosen.

Cancellation and completion

Either party may cancel before work begins, subject to the cancellation terms in the accepted quote. Once work has begun, cancellation is settled between the parties, with WorkLink assisting where a dispute arises.

An order is complete when the agreed deliverables have been provided and the buyer has approved them, or where the approval window has passed without a dispute.

Disputes

Raise the issue with the other party through the platform first. If it cannot be resolved, either party may open a dispute and WorkLink will review the quote, the order, the messages and the delivery record.

WorkLink's role in a dispute is to apply the platform's rules to the record of quotes, messages and the project. It is not a determination of legal rights, and nothing in this agreement prevents either party pursuing a legal remedy.

Australian Consumer Law

Nothing in this agreement excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
